Go Green Terms and Conditions of use

These terms and conditions apply to the use of the Go Green platform, including the website gogreen.axa.ie (referred to herein as the “Platform ”). By using the Platform, you confirm your acceptance of these Terms of Use.

We may, without liability, revise these Terms of Use at any time without notice by amending this page. You must check this page from time to time to take notice of any changes we make, as your continued use of the Platform after such changes are made shall be deemed acceptance of them.

AXA may (but shall not be obliged to) update the Platform from time to time or discontinue the Platform or any part of it entirely without notice to you. AXA will not be obliged to maintain or provide support to you in connection with your use of the Platform.

The Platform is provided by AXA Insurance dac ("AXA"), a company incorporated in the Republic of Ireland under company number 136155 and whose registered office is at Wolfe Tone House, Wolfe Tone Street, Dublin 1, Ireland

Obligations of Partners

Any contract which is concluded between you and a Partner participating in the Go Green offering is between you and that Partner. We understand there may be times when you do not receive the service you expect. Where this may be the case we invite you to contact both the Partner and ourselves. This can be done by emailing Go Green at gogreen@axa.ie

User Submissions

Any communication you send or transmit to AXA in relation to the Go Green service, whether by post, email, the Platform or any other means whatsoever, shall be treated as non-proprietary

Commercial exploitation of the Platform is strictly prohibited

AXA reserves the right to prevent further access by you to the Platform for violating these Terms and Conditions, or use of the Platform or transmission or posting communications to the Platform, which AXA deems to be in breach of these Terms and Conditions.

Users of the Platform agree not to: a. Use the Platform in any unlawful manner or in a manner which promotes or encourages illegal activity; or b. Attempt to gain unauthorised access to the Go Green services or any networks, servers or computer systems connected to the Platform; or c. Modify, adapt or reverse engineer any part of the Platform or re-format or frame any portion of the pages comprising the Platform, save to the extent expressly permitted by these Terms and Conditions or by law; or d. Submit any offensive or defamatory messages, comments or material to AXA

Intellectual Property

The copyright in all material contained on, in or available through the Platform, including (without limitation) all information, data, text and graphics, the selection and arrangement thereof, and all source code, software compilations and other material (“Material”) is owned by or licensed to AXA or its group companies, Partners and service providers. All rights are reserved. You cannot copy, edit, vary, reproduce, publish, display, distribute, store, transmit, commercially exploit, disseminate in any form whatsoever or use the Material or any part thereof without prior written permission.

Offences

You must not misuse the Platform by knowingly introducing viruses, trojans, worms or other material which is malicious or harmful. You must not attempt to gain unauthorised access to the Platform, the server on which the Platform is stored or any server, computer or database connected to the Platform.

If you attack the Platform you may be committing a criminal offence. We may report any such offence to the relevant law enforcement authorities and we will cooperate with those authorities by disclosing your identity to them.

Changes

AXA may at any time, without liability, modify, suspend, update or discontinue the Platform, these Terms and Conditions and/or the goods and services advertised on the Platform or any part thereof, with or without notice for any reason whatsoever. AXA will not be obliged to maintain or provide support to you in connection with your use of the Platform. By using the Platform, you agree to be bound by any such changes. You should visit this Platform from time to time to determine the terms and conditions by which you are bound your continued use of the Platform after such shall be deemed acceptance of these terms and conditions.

Disclaimer/Liability

USE OF THE GO GREEN SERVICES, INCLUDING (WITHOUT LIMITATION) THE PLATFORM, IS AT YOUR OWN RISK. THE GO GREEN SERVICES, INCLUDING (WITHOUT LIMITATION) THE PLATFORM, ARE PROVIDED ON AN “AS IS” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW: (A) AXA DISCLAIMS ALL LIABILITY WHATSOEVER, WHETHER ARISING IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE IN RELATION TO THE GO GREEN SERVICES, INCLUDING (WITHOUT LIMITATION) THE PLATFORM; AND (B) ALL IMPLIED WARRANTIES, TERMS AND CONDITIONS, INCLUDING (WITHOUT LIMITATION) ANY WARRANTY, TERM OR CONDITION AS TO ACCURACY, COMPLETENESS, SATISFACTORY QUALITY, PERFORMANCE, FITNESS FOR PURPOSE OR ANY SPECIAL PURPOSE, AVAILABILITY, NON-INFRINGEMENT, INFORMATION ACCURACY, INTEROPERABILITY, QUIET ENJOYMENT AND TITLE, RELATING TO THE GO GREEN SERVICES, INCLUDING (WITHOUT LIMITATION) THE PLATFORM, WHETHER IMPLIED BY STATUE, COMMON LAW OR OTHERWISE ARE, AS BETWEEN AXA AND THE USERS OF THE GO GREEN SERVICES, INCLUDING (WITHOUT LIMITATION) THE PLATFORM, HEREBY EXCLUDED. IN PARTICULAR, BUT WITHOUT PREJUDICE TO THE FOREGOING, AXAIRELAND ACCEPTS NO RESPONSIBILITY FOR ANY TECHNICAL FAILURE OF THE GO GREEN SERVICES, INCLUDING (WITHOUT LIMITATION) THE PLATFORM; OR ANY DAMAGE OR INJURY TO USERS OR THEIR EQUIPMENT AS A RESULT OF OR RELATING TO THEIR USE OF THE GO GREEN SERVICES, INCLUDING (WITHOUT LIMITATION) THE PLATFORM. AXA ACCEPTS NO LIABILITY OR RESPONSIBILITY FOR TECHNICAL ERRORS OR COMMUNICATION FAILURES IN NETWORKS AND/OR INTERNET ACCESS. AXA DOES NOT MAKE ANY REPRESENTATION THAT THE GOODS AND/OR SERVICES OR PARTNERS ADVERTISED ON THE PLATFORM ARE APPROPRIATE OR SUITABLE FOR USE OR THAT THEY COMPLY WITH THE LEGAL OR REGULATORY REQUIREMENTS OF ANY LOCATION. EACH USER OF THE GO GREEN SERVICES, INCLUDING (WITHOUT LIMITATION) THE PLATFORM AGREES TO INDEMNIFY AXA AND ITS GROUP COMPANIES IN FULL AND ON DEMAND FROM AND AGAINST ANY LOSS, DAMAGE, COSTS OR EXPENSES WHICH THEY SUFFER OR INCUR DIRECTLY OR INDIRECTLY AS A RESULT OF THE USER’S USE OF THE GO GREEN SERVICES, INCLUDING (WITHOUT LIMITATION) THE PLATFORM, OTHERWISE THAN IN ACCORDANCE WITH APPLICABLE LAWS.

AXA WILL ENDEAVOUR TO ENSURE THAT THE PLATFORM IS ACCESSIBLE FOR 24 HOURS A DAY BUT WILL NOT BE LIABLE IF‚ FOR ANY REASON‚ THE PLATFORM IS UNAVAILABLE FOR ANY TIME OR FOR ANY PERIOD. AXA WILL HAVE THE RIGHT TO SUSPEND ACCESS TO OR WITHDRAW THIS PLATFORM TEMPORARILY OR PERMANENTLY AND WITHOUT NOTICE. AXA WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE ARISING IN CONTRACT‚ TORT (INCLUDING NEGLIGENCE) OR OTHERWISE IF THE PLATFORM IS UNAVAILABLE OR SUSPENDED FOR ANY REASON.

AXA DOES NOT WARRANT OR REPRESENT THAT THE PLATFORM IS FREE OF VIRUSES OR TECHNICAL DEFECTS OF ANY DESCRIPTION‚ AND ACCEPTS NO RESPONSIBILITY FOR ANY TECHNICAL PROBLEMS ARISING FROM YOUR USE OF THE PLATFORM.

AXA WILL NOT BE HELD LIABLE FOR ANY LOSS OR DAMAGE CAUSED BY A DISTRIBUTED DENIAL-OF-SERVICE ATTACK, VIRUSES OR OTHER TECHNOLOGICALLY HARMFUL MATERIAL THAT MAY INFECT YOUR COMPUTER EQUIPMENT, COMPUTER PROGRAMS, DATA OR OTHER PROPRIETARY MATERIAL DUE TO YOUR USE OF THE PLATFORM OR TO YOUR DOWNLOADING OF ANY MATERIAL POSTED ON IT OR ON ANY WEBPLATFORM LINKED TO IT.

The Platform may contain links to other websites which are outside AXA Ireland’s control and are not covered by these Terms of Use. Where the Platform contains links to other websites and resources provided by third parties, these links are provided for your information only. We have no control over the contents or terms and conditions of those websites or resources and accept no responsibility for them or for any loss or damage that may arise from your use of them.

Miscellaneous

When you use the Go Green services you must comply with all applicable Irish laws and with any applicable local laws in your jurisdiction, if different (together referred to as “Applicable Laws”).

Access to the Platform from locations where the contents of the Materials or the services or goods advertised on the Platform are illegal is prohibited.

These Terms and Conditions shall be governed by and construed in accordance with the laws of Ireland and the Irish courts shall have exclusive jurisdiction for the purpose of any proceedings arising out of or in connection with the Go Green services or the Materials.

If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions, which shall remain in full force and effect.

No waiver of any term or condition of these Terms and Conditions shall be deemed a further or continuing waiver of such term or condition or any other term or condition.
